Gerry Thomson, a furniture restorer, was cycling to work one morning when she was knocked off her bike by a Council van which had failed to stop at a “give way sign”. Although she was thrown across the road by the impact, there was fortunately no approaching traffic, but she did suffer a perforation of her small bowel, probably caused by her own handlebars.
Her injury required a surgical repair in hospital and recovery was initially prolonged because an abdominal abscess formed around the wound.
Gerry went on to make a good recovery and was able to return to work after a few months but had to take it easy, on lighter duties for six months and she has been left with an abdominal scar.
A claim was advanced for her injuries, loss of income, for care provided by her family and for the cost of plastic surgery to revise the scar should she want it.
We obtained reports from a consultant general surgeon and a plastic surgeon. As soon as they could give a clear prognosis, we were able to quantify her claim and after productive negotiations, the Council’s insurers paid compensation of £22,500 and her costs in full. We acted for Gerry (not her real name) under a No Win – No Fee Agreement.
